I hv asked a quarry earlier, I am not satisfied with the answers:

1) I asked about alimony. If wife is earning handsome salary, then is it fair to ask for alimony? whether court will give such alimony?

2) I asked for mandatory six months gap for first motion and second motion of divorce. I like to know whether it can be dispensed with or not?

1. No alimony can ordered in this matter.

2. The period of six months cannot be dispensed with at all. It is mandatory.

No.. Its wrong.. You can dispense the 6 months periods before the district family judge..

THE SECTION 10 [A] [ii] OF INDIAN DIVIRCE ACT allowing to dispense the 6 months periods..

Dear Mr Tom, as per the recent decision of the supreme court the said period of 6 months can not be avoided.
Another thing I could not find any statute called Indian Divorce Act. I would be thankful if he guides me to find that one.
Section 10A of Divorce Act however is not telling anything about any waiver of time.

on 30.2.2010 i filed the mutual divorce petition before the district family judge of coimbatore [TAMILNADU] along with dispense petition.. its numbered as d.o.p 100 of 2010 and posted on 03.03.2010 for appearance of parties.. same day i took evidence.. and its posted on 23.03.2010 for orders. PETITION IS ALLOWED.
