CHEQUE BOUNCE

I had filed a suit for Rs. 3600000/- being receivable against a debtor the judgement came in my favor. The accused in the given case filed before the sessions court after having lost before THE MM COURT. the accused than at the sessions court failed to pay the min amount and hence the sessions court ordered for issue of conviction warrant.
The conviction warrant is still not executed means that the person is unreachable. He had filed an appeal before the HC seeking stay against the conviction warrant.
The date was supposedly on 03.09.2019. However today the date changed from 03.09.2019 to 28.01.2020. the next date at sessions court is 24.09.19. The R AND P IS HELD at the MM COURT due to non execution of conviction warrant . Request you to kindly guide whether this case will go ahead on 24.09 or the time will be wasted.

Domestic violence allegations

Hi all, My wife left my house around 4 months back. I sent her a legal notice calling her for mutual divorce. Now she has put domestic violence allegations against me in police station. I was called and warned by the inspector. He gave me a weeks time to take her back. My lawyer is suggesting me to apply for divorce as soon as possible. Still the complaint has not been converted to FIR. I dont want my wife back in my life. I want to get separated. Can you plz suggest what should i do now. Should I take anticipatory bail. Or shld i wait for the complaint to get converted to FIR. She has named my entire family in the complaint.

False fir of rape on pretext of marriage

My girlfriend (live-in partner) has filed an FIR under section 376 (rape) and section 420 (cheating). She has alleged that I have raped her for 2 months after false promise of marriage. Medical report has confirmed no sign of injury, no evidence of sex and no pregnancy. I am a government employee. I have been suspended from job on ground of moral turpitude.
1. How to proceed in this case?
2. Can I file a counter FIR? If yes, then under what sections?
3. Which one is recommended - civil defamation or criminal defamation in this case?
4. When can I file a defamation case against her?
5. She has forged her signature on rent agreement. Can I use it as a document to book her under section 468, 469 of IPC?
6. When and how can I get my suspension revoked?
7. What kind of effect will it have on my job,subsequent promotions and while filling of other government exam applications?

Mutual consent divorce by nri

Please guide/advise:
She is NRI staying in Aust. He is in India.
The marriage was in Old Customs Registrar office in Mumbai in Dec 17. She left to Aust after 3 month as they could not adjust with each other. They have now mutually agreeing for divorce here in Mumbai.
1. For filing petition, does she have to be here?
2. For any further needs by court, does she have to attend personally or can have POA?
3. How long should it take to get divorce?
4. How much expenses will there be till get divorce papers?
5. Pl. suggest a lawyer Mumbai from Mulund to Gahtkopar.

Anticipatory bail u/s 120b, 114, 420, 406

Someone launched FIR against my friend u/s 120b, 114, 420, 406. My friend's role only give to 1 person number. But somehow complainer of fir loosing cash money by some other persons. Main culprits got anticipatory bail from gujarat high court as a condition to pay Rs.17 lakhs cash and Rs.10000 bail bond as a surity in police station and this cash money can also withdrawn by complainer any time. My friend is not guilty and he don't have money to pay Rs.17 lakhs. So any chances go get anticipatory bail and have you any judgements of high court's regarding related case. Plz help me as soon as possible

40 year old shop owner filed case for leaving the shop

Dear Sir/madam,

My Father is having a Shop on rent from approx 40 years and contentiously paying rent on time. 3 Landlord changed during this period.
Now Current Landlord have lodge the case for leaving the shop.
This shop is only the source of income of our family.
Owner is having so many land and buildings but they have register this shop with name of his daughter thats why the case is made so strong as they said to the court that this shop will be the source of income of my daughter.
We have appointed a lawyer but seems to be very weak.
Please suggest some thing.

Case 125 (3)

The marriage was solemnized on 17th Jan 15, was declared void by degree on 2nd Nov 2017 (by family court Indore) Meanwhile lady had field case u/s 125 and got order(ex parte) on 10th July 17 by family court Surat where she stays. After that she filed recovery suit u/s 125 (3). What should be my approach for:

1. Which court I will have to approach.
2. Should I approach high court Ahmadabad for with copy of void degree to quash order.
3. Should I approach court hearing 125(3) application with copy of void decree and request them to take cognizance of this issue.

Do guide me.

Appeal against acquittal u/s 138 of n.i. act

Dear sirs,
A private complaint filed by me in a JFCM court was dismissed and the accused was acquitted. My advocate filed on behalf of me an appeal in the District Court, Chittoor of Andhra Pradesh which has got numbered and taken on file. The case is posted to 8th March 2018 for hearing.
Recently I came to know that District Courts are not competent to take appeals against acquittal. In these circumstances my request is can I file a S.L.P. in the honourable High Court when the appeal is pending before the District Court? Will the honourable High Court condone the delay in filing S.L.P.? The problem arose because of my advocate but not of me. what can I do in this matter?

Bank mortage vs personal property

Hi I am a Managing Director of A pvt ltd company Which has taken a loan from a Nationalized bank.Due to Heavy loses in the Industry ,the industry was not able to pay back the loans.The account was declared as NPA by the bank one ago.Industry property and Lot of Other Urban properties were mortgaged for the loan in the bank. Bank eAuction Process is going on. Bank valuation on properties much lower to market value which created recovery gap. Bank filed a case to acquire personal properties of directors. Could you guide me how do I safeguard my personal property.

My personal property which I was referring not mortgaged to the bank but title documents are lying with Home loan department of same bank in other state which they have hold documents due to internal communication about the bank dues.

Could you guide me how do safegaurd my property and get the documents from the bank?
