Adoption deed

If husband and wife have already two child 1 son and 1 girl, now again she is pregnant and wants to donate her third child to other couple, then it is legal or not?
Which type of Deed we considered?
Any other options?

498a false case

my wife & her family mamber warning us for a false case 498a dowry. Now they are almost ready for file a 498a case. If she file 498a What is the procedure of bail, & bail cost,& time.And what type of precaution we need.we already filed a police complaint in may'2010 against her& her family mamber.and my mother disowned my by legaly & public notice.
now what should we do.

Ld counsels,

Wife alleges that husband did not participate in particular ceremony of marriage which is essential even after elders persued him and hence the marriage did not solemnize.

At the same she claims that only after few days after coming to the matrimonial home she came to know that husband was unwilling to marry and he deliberately suppressed. Is it not inconsistent and mutually destructive to say that marriage not solemnized bcs husband refused and later coming to know that husband was unwilling.

when the wife claims there is no marriage solemnized can she claim that husband is impotent bcos of this marriage is not consummated.

Please clarify. Thanks.

Opposite party absent after filing ia for potency test

wife made impotency allegation in annulment petition, and husband filed IA for his potency test. Then wife is absent but her advocate is present on last three dates. Will her absence lead to exparte order in IA? I just want to know whether the court allow me for potency test if she remains absent in the following dates also?

Death claim

Sir/madam
Mr suresh is a employees in CRPF.after his marriage wihin one year a complain suit against him and his parents u/s 498 A/294/506/323/34 IPC.and police arrest him and his father ,after 6 days they are relies on bail.
Case start from 2007
Suresh join his job but ,against party approach to commandment that my husband spend 6 days in jail and punished him.mr suresh suspend for three month.
Last 9 month court order to give maintenance Rs3000/pm.suresh deposit all the amount in court,but the party again suit new case to increase the amount to Rs7000/pm.
Now Mr suresh Died Dec2011 on duty at J&k.the dead body handed over to his mother at home town.
Mr suesh no children, after suit case his wife leaving with another person iligaly,sowing that he is my brother. That man handle all case on behalf of his family.
My question is in CRPF record nomination was not change after his marriage, mother is 100% nominee.
In this circumstance who will be the beneficiary of mr suresh’s pension and all other death benefits.
Mother age was 61 years,Mr suresh age was 31 years

Will this amount to res judicata

Ld counsels,

Wife made certain allegations in OPwhich are denied by husband in his written statement. Based on this denial wife filed an IA for documentary proof to prove the allegation which was denied by husband. Husband was set exparte in the IA. The relief for production of document was granted.

Will this ex parte order in IA operate as rej judicata on husband to further deny the allegation made in OP. Please clarify. Thanks.

Marrying 4 wives by mohammadan-fundamental right or not

dear experts,
my client is the 1st wife of a mohammadan and he said Talaq to her and is also matter in question. a 125 Crpc petition is also pending. meanwhile the man, tried to marry a girl. immdealtiely my clietn filed a civil suit reastraining the man from marrying another girl. now the man appeared and resising the suit under Order 7 rule 11 (d) of CPC, that there is a bar to proceed with the suit, since every mohammadan is having right to marry 4 wives. now my question is
1.whether the right of marrying 4 wives is a fundamental right of a mohammadan or not?
2. Whether is there any legal bar to filing a suit by a mohammadan lady?
3. wheterh the reported ruling in 1985-SCC-vol-2 page 556, a five judges bench of Supreme Court would help to this issue?
4. Is there any other citation in that aspect?

Ascertaining share in joint agricultural land of family

My father had agricultural land in a village in Maharashtra state. He died without making will. He has five sons and a daughter. I am one of those five sons. Out of those five only my elder brother and I and my sister are alive. My name and my alive brother's name is in the record of 7/12 register.My sister's name and the names of three deceased brothers are also there in 7/12 register as the legal heirs.I and my brother and sister want to sell our share from this land. But the children of my three deceased brother are not cooperating to devide the land to ascertain the indivisual share of legal heirs.

I have been staying away from the village for past 40 yrs. and I want to sell my share from this land.

I request for guidance as to how I should go about to get my share in this land ascertained so that I can sell it.
