Adoption deed

If husband and wife have already two child 1 son and 1 girl, now again she is pregnant and wants to donate her third child to other couple, then it is legal or not?
Which type of Deed we considered?
Any other options?

you can give your child in adoption through adoption deed.There is no other way.

Yes. It is legal to give the child in adoption. But, first you have to verify whether the person who is adopting the child is eligible to adopt a child.

You have to execute a deed of adoption to that effect. There are no other deeds with regards to adoption.

Well you have full right to give but at the same time the person those who have capacity to maintain the child. Should be confirmed. The transfer should by the way of deed of adoption

Querist,
Adoption Deed is by no means necessary, but is important because it gets difficult to prove an oral adoption. Adoption Deed (a simple document - need not be registered) once made is prima facie evidence that all requirements of adoption as stipulated under Hindu Adoptions and Maintenance Act, are met. However do consult somebody to ensure that person receiving are entitled to do so under the law.

Couple can give child for adoption, if both parties in adoption process are Hindus and other party adopting child, if child is male, has no male child and if child is female has no female child. Though adoption deed is not necessary but it is always better that adoption must be registered as under Section 16 of the Hindu Adoption & Maintenance Act provide that deed of adoption shall give conclusive presumption of adoption.

Deed of Adoption or Agreement is not valid,those who want to take an adopted child he should file a petition in District Court under Hindu Adoptions and Maintenance Act.with due notice to the guardian of the child.
