Dear Sir,
My wife sent me divorce notice through court person to my resident but in the absence of my the notice letter is return to the court . So can any body help me what to do in this case. Also I need a Family lawyer to handle this case. So please can anybody suggest me. the date is given in the march. this is the first date. this matter is in the thane family court.

Hi,
I am falsely entangled in this s313 mess. My wife and I decided mutually to undergo the termination of pregnancy in May 2010.
We separated in Jan of 2011.
In November of 2011, she has filed a court complaint against me alleging that I forced her into undergoing this procedure.
Now, my q. points are,
1) Can she simple allege without evidence?
2) If her signed consent forms from the clinic are provided to the court showing she was consensual to this. Will it be sufficient to quash the case?
3) If the consent forms are shown to the case;and the case is quashed. Can a case be filed against the girl for damages caused due to unnecessarily causing mental torture and harassment to my family and myself?
4) Is there any good advocate in Bangalore who could please drop in a line to me so I can contact them?
5) This case is also followed by 498a; which I would like to discuss with someone knowledgeable in person.

Suit for partition decreed. final decree was also passed. The portion allotted to me is in possession of a tenant. Now i have been advised file execution petition to take physical possession of the property which allotted to me. what is the procedure. how do i get possession from the tenant.
plz advice me with some citations or provisions of law.

In a divorce case, petitioner is absent on last three dates continuously but advocate is present. But the judge is giving next date saying petitioner is absent. So, can I ask for cost in such a situation? Can I request the court to close the current step and proceed to next step? why the judge not ready to proceed the case even if advocates and respondent is present?

Hello everybody I had filed a judicial separation case against my wife 6 years back, the case is on the cross examination stage,
Can I make amendment in the prayer and ask for divorce? If it can be done is there any case law on similar facts ? Please Help!
If wife is filed Sec- 13 (Divorce)
if husband accept the Divorce
then even maintenance is must for wife.
If any ruling or judgement pls. inform us.

My husband applid fr divorce and i applied for RCr but he is not appearning for both the cases in court. I am planning to put litigation.
1. What are all the details i shld include in that?
2. For Litigation will they combine the dates with RCR?
3. How long it will take to pass the order for litigation? (Chennai)
4. IS ther any limitation for maximum amount? I am planning to put 60000. I gave 50000 as fees to lawyers for Divorce,RCR and trnasfer OP of divorce to my jurisdiction.
5. when i apply for litigation, wll he recieve any summon to his home?
Dear Experts,
Sir My wife filled a DVA & interim Maintenance on me & in-laws. I have filled an RCR for re-union & visiting rights for my 3 old male child. In Dva it is the time of Chief Examination. As the DVA is a false litigation she is now afraid to face it. Her lawyer is asking us for an Mutual Divorce. As per my mind I need my child for my life & also we cannot compel or request anybody to live with us. So I told ok I am also ready for Mutual Divorce but I need the child or Visiting Rights. Her lawyer said Mother is the natural Guardian of male child according to LAW. But my lawyer told Father is the natural guardian for male child. But they are not willing to give my rights to the child.
1. Which is true sir? Father or mother
2. Can I move the case or shall I go Mutual Divorce?
3. I told them I am ready to give maintenance to child also, In mutual divorce.
Please Clear my doubts sir as I put all these in my mind these thing I got Low BP & illness.

Marriage happend in Jan'2008
Came to know wife suffering of BPD in march'2008 due to taking medicine.
Tried to ask her but no answer ,also taken up the matter with myinlaws but no response from them.
My father fill ill in april'2008 as he was suffering from parkinson. He passed away in aug'2008 in Lucknow.
I came to delhi on 22nd Aug'2008 .Leaving my wife in Lucknow as my mother was alone and she had to return on 30th Aug'2008 .But she had an attack of BPD in 25th Aug'2008 and on 26th her father came and took her to aligarh to get her diagnosed where her medical treatment was going on .We had also got the checkup done by Dr.S.Singhal whose prescripttion was taken up by her father.
We tried asking them the details twice in Jan'2009 and Jan'2010 but not getting any answer we send the legal notice thru our advocate in feb'2010 in retaliation they filed 498a,406 and 125 crpc in Aligarh .All were complaint case .I filed divorce after this in New Delhi
Case were transfred to mediation cell at aligarh district Court .After several round of mediation we aggred for the same in Aug'2010 thru payment of money.Terms were of withdrawing of all the three cases and mutual divorce.But till date they haven't given the divorce.
I had then filed the divorce on 31st Oct'2011 in aligarh court on grounds of cruelty. In reply to my petition the Ws given is that we had to pay clothes and jewelery .But there was no such aggrement. between us.
Kindly advice what should be my next steps .Are there no laws to deal with such types of greedy people.
Note: Settlement letter was made and signed by lawyers from both the sides including the mediators and both the parties. Mediation took place at Aligarh Mediation cell of Aligarh District Court

An Indian citizen married in U.S.A. to American Citizen
girl of Indian Origin has family break up coming to divorce in the foreseeable future.
If this person comes to India to escape to avoid bankruptcy then will he be forced to go back to U.S.A. to stand trial .
