Not paid as per lease agreement.

dear sir , we have given a plantation to one person for 3 years that is like lease and he has to provide us a fixed amonunt per year as per the aggreement and he only paid for 1 year and did not paid for next 2 year and now he is not coming into contact . police saying it is Civil Case . please let me what we do now and is not is is Cognizable offencive ? thank you.

Non payment of rent is not a criminal. You can send him a legal notice through an advocate and then proceed as per the advice of your engaged advocate.

but it is not like rent , he put fertilizers and waterign the trees and has to make the payment as in the agreement he promised sir.

On the basis of the agreed terms he is found to have violated the contract terms and conditions hence you can issue a legal demand notice demanding him to pay the compensation and the loss for the damages as well as the balance of rental amount, failing which you may file a suit for recovery of money in the appropriate court
