bank maneger did froud n taken cheque

Bank maneger denied to open pmjdy account and open regular Account and taken cheque froudly by saying that its our formalities we have to keep the cheque.

Have evidence in banks cctv but police not Lodging FIR

Want to file an Complaint to magistrate with 156-3 CrPC

Under what section i can file Complaint againg bank maneger , SHO , SP

You can complaint to police for any criminal acts, police would apply section.

You can lodge complaint with the Head office of the Bank, RBI, Banking ombudsman or lodge consumer complaint for deficiency of service.

No Manager will deny opening of PMJDY account. What cheque you have given to him? Whether the cheque is encashed? He might have accepted the cheque for opening the account and until andunless the cheque is cleared, he cannot open the account. Nothing is clear in your query. Please come with full details.

I make my question more clear
My client visit bank for open pmjdy Account , bank maneger open a regular Account with 1000 deposit amount , after few days bank manger call my client to visit bank n in bank he handover the cheque book n the same time he takes 11 blank cheque after that my client leave the bank with rest cheque book n reached home there some educated person told him that it is wrong bank maneger take ur cheque frodly n etc , after that same day he visit bank again with his son n demand for the cheques but bank maneger throw him out from bank . After 2 days my client visit police station n SP office but no positive response came out till today no FIR logde my client is ilitrate n have no knowledge of cheque

Now the bank maneger ready to give bake the cheque

R/all please suggest me i have to file Complaint to magistrate or just leave it

Whether the cheques taken by the Manager were shown issued in your account? It seems the chequs issued to account holder were only shown issued for the account and extra cheques were taken out from the cheque book.

No Manager / Bank employee would dare to use such cheques fraudulently. If you are not satisfied, open new account and after some time close this account.

It seems you are taking extra cautions without going in procedure.

You have option to write to higher officers of the Bank.

lodge your facts with the police or s.p. of the district by visiting the office or by post and wait for some considerable period to see the action taken by the police or by the s.p. of the district and thereafter you may place an application under section 156 (3) of cr.p.c. before the competent criminal court, through your advocate at the said court.

Thanks all R/senior already long time since 22th april my client waitong for fair justice but till today no resp9ne there is only one evidance that is cctv footage of bank the police not yet take the cctv footage in his custdy

If you have obtained the acknowledgment/diary number of the complaint given to police, and complaint sent to Chairman/vigilance cell of the bank then you can seek reply thru RTI on action taken and report filed...............


If the bank is private file RTI thru RBI..


The Bank shall part with CCTV footage if ordered by law enforcement agencies,court of law............

Thanks to the author for keeping mum on the questions raised by the experts for incomplete information for his academic and imaginary story.
What is the intention of bank manager in retaining 10 or 20 unsigned leaves of cheques out of the cheque book issued to the account holder? Moreover, there are clear instructions of RBI to all the Banking Institutions to send cheque book(s) by post to the account holder and no bank shall issue cheque book by hand, even if the bankers know the account holder personally.
Where is the fraud committed by banker? What is your complaint before the magistrate (u/s 156(3)Cr PC)? How did you plan to convince the court for issuance of directions to the police for lodging FIR against the banker?

Have you taken up the matter with the Banking Ombudsman besides lodging a complaint against the branch manager to his controlling office? Solutions are simple upfront at this level itself.
