Query about practising area

firstly! Happy EId to all....

Sir,

I have been completed my 3 years law dergee and i am being enroll as advocate.
I am going the submit my enrolment form is the bar council of delhi.
I would like to know about can i only practise in state of delhi or can be practise outside of state of delhi.

Anywhere in India.However, U cannot file Vakalatnama in any court outside your State but may appear as a counsel.

Congatulations to become an Advocate. In fact, practicing in Delhi will make you more bold, because from the Traffic Challan Court to Supreme Court, everything is at waking distance.
Under Sections 30 and 49(1)(ah) of the Advocates Act, 1961, read with Rules of the Bar Council of India, Chapter-III, Conditions for right to practice, the Rule/ Para-1; you can practice law anywhere in India, but you should have your permanent practice at Delhi/ the place of your registration. If you continually practice for 6 months at another place, you should apply for transfer of your enrolment to that place’s Bar Council, or you are committing Professional misconduct.

While I had been at Delhi, with Bar Council of Delhi Registration, in the year 2005, I had filed my own Vakalatnama at Meerut Courts. In the year 2006, I had filed my vakalatnama at Muzaffarnagar Courts. The Bar Associations at that place did not object for that. But please check the present “practice”. Law is one thing and local custom and practice is another thing.

Never loose honesty to your clients and other Advocates. Lawyer’s profession is not Lier’s profession. When you speak the truth and will refuse to mislead, normally you will have a honest face and “non tricky” eyes, which is only going to be your asset/ stepping stone in any employment and especially Advocate’s profession.

Sir,

I would like to work with senior advocate with deals mainly in taxation to gain knowledge. Is any gentle man help me on this issue. I am also a master degree holder with law degree and expect in computer applications.

Sir,
if you want to be successful as an Advocate, for at least one year, work with any Trial Court Advocate at tis hazari court etc; with pre condition that he will also send you for Challan work.
Reason is, if you know the lowest to highest work, if you are certain about your correctness, at any moment you can put your eyes into the eyes of any Judge or Policeman and tell that, what you are saying is correct and without fearing consequences of personal revenge, contempt false complaint etc, you stand for that.
Please note, in the Damini Cinema, the client got was in Magistrate Court. In Halla Bol cinema, as per your choice, there was Income Tax Raid at the premises of Hero of that movie.
the point is, you should know all the works, then only you can have courage about falling down to any depth as a result of revenge upon you.
I am an Ex-service man (not as per present definition, but in reality), thus once i had to explain how Bombs are made, to tell that, i will install such a bomb underneath the Cars of two ADJs of TH court, to ensure that, they will not take bribe from the opposite party to fail my client. I told them, to dispense the services of Drivers. Hence my point was correct, my challenge was not even recorded, but they behaved properly. Means to get justice to my client, in the year 2001, i had to take power of my life as a Soldier. In Damini Movie, the Hero had to tell about weight of his blows to Opposite Counsel and his goondas. Compare that with your intention to work only in Tax Law.
After learning work at Trial Courts, for couple of years, you can specialise in Taxation. the benefit will be, if any Damini will seek your help, you will be able to get her justice.

Welcome to the noble profession of advocates. Keep up the dignity of the profession. You may enroll in one Bar council and practice occationally in courts anywhere in India. But if you change your normal practice to a place of different state, transfer the enrollment to Bar Council of that state. Wish you good luck.

I am very happy that, i am getting a lot of good words from the persons reading of this page, whereas due to me the topic diverted from place of practice to professional ethics to how to withstand bullying Judges or Policemen. My reply is simple - if they can tell you that, we will create problems for you the advocate, you will hesitate to come to us, and you will be fish out of water - if you know only one Court/Forum's work.
But is you know the work right from Challan Court, you will be able to tell that, no one can deny your place of working - that will result in more boldness.
WHY I STARTED TO WRITE THIS MESSAGE IS, when i gave my first reply, at the same time i wrote one more reply in the page If-girls-family-break-engagment-what-can-boy-do--, till now no one acknowledged my answers in that page.
Anyway it is life.
