Hello,
I want advice from you in my problem, my husband take credit card from long, in 2006 he go another country and work. He no come to India, some time he come to see his son and he support him studies. He have another family in the another country.
Now credit card people are coming every day to my house and troubling me for paying credit card outstanding of my husband which he no pay from 2006.
I no have money sir to pay I am afraid sir as people come month month and ask me my husband detail and money.
What I must do sir tell me.

Credit card recovery people have to observe certain guidelines fixed by RBI.
The outstanding seem to be old enough and seem to be time barred.
If Recovery Agents go beyond the RBI directives, lodge complaint to Bank Head office, RBI, Banking ombudsman and in need file FIR against the Bank Manager and recovery agent.

It is time barred claim. The bank can not recover the money anymore.
Still to avoid any harassment you can settle the dispute to any agreeable amount.

Sudirji and Rajeevji He is not in contact with me from 2006 then how can I tell him to pay. If I am able to contact him then I will ask him to come and stay with me and my son but we do not know where his country home is.
Goyal Sahb can you tell me the guidelines fixed by RBI. I am heart patient when some one come to my home when I am alone and ask about my husband I feel afraid. what is time barred means sir. Where is banking ombudsman.

Thank you Devajyoti ji, I work only daily salary in Saree shop so money i get salary no enough for food. So i no pay them.

Time barred means after the certain time period fixed by RBI the bank can't recover outstanding dues. The Ombudsman office of Banking is varied from Bank to Bank. It depends upon which Bank have issued credit card.

You inform the bank, the address of your husband.
If they trouble you further, you can give a police complaint on them.

YOU have to muster courage and shrug off the guilt that has been unnecessarily bothering you.
Bank/CC company can not ask you to pay.
If you have told them once not to call you/come to you they can not call/come.
Record their calls/visits (audio/visual) and call police...................and submit written complaint to commissioner of police, women cell, Chairman of the bank with copy to:

agreeing with other experts I would add that though you are heart patient but have no choice to be tough with your husband as well as recovery people. None of them is going to cure or care for your heart problem.

File a police complaint against the persons who are making visits to your house frequently narrating the entire story to the Station House Officer (SI). The best way is to forget. They cannot do anything to you. You are not aware of whereabouts of your husband. Why do you worry?

Simply tell the recovery (credit card) people to contact only the credit card holder (your husband) and don't come to you any more, If they still come and harass, just call the police by dialling 100.

You need not to pay even a single paisa for the loan of your husband. You can give a police complaint in local police station and also get a permanent injunction/temporary injunction by filing civil suit against that bank, its officials and its recovery agents to visit you at your place.

Next time when somebody knocks your door for credit card money, take down their name and address and lodge a complaint against them for harassing you unnecessarily, that is the best option available.

We have seen it in many cases that many customers and citizens become unforgiving in such cases and when customer/citizens become unforgiving these recovery agencies and agents that pose as tough, shameless plead for mercy and pardon.
The police officials are quick to sense that the crowd of citizens is determined and if they do not act they may approach their superiors, magistrate, media and then they also become unforgiving.
The managers of the bank, CC companies then do not hesitate to tender apology in writing.
In all such cases the agency is terminated, agents are terminated the managers in bank/CC companies in almost all cases simply disappear from the city.
It has been seen that they reform and they do not indulge in such practices.
The united community of citizens can achieve anything.
After such a thorough discussion if the querist acts tough then one more agency, agent, CC company shall be reformed.
Such persons be it agencies, agents, managers in Bank/CC company are not fit to be left to loose around in a civilized society.
