Dear Experts,

My Brother is working in a government undertaking company, since Feb or Mar he has been suffering from illnesses and anytime got fever or headaches.

One day for the same he had sever pain in his head that's why he taken some rest on his chair with closed eyes. A person captured a video, he is not his boss or in the same department. that person posted that video on his facebook saying "people getting salary for free" but everyone in my favor because they know I have been ill for long time.

But that person did not stop by doing this, he sends that video on people's whatsup too.

So could you please assist me how can I control this, is it a crime?? What would be procedure to complaint in this regard??

You can file defamation case against the person and ask for compensation. Please appoint advocate for the same.

You can consider defamation if the video contains false assertion

Video of a sleeping person does not form a cause for defamatiom suit by itself unless some really defamatory text is appended. Suit of defamation is like quicksand, the more one tries to wriggle out the more he sinks in. Since you did take a little nap, explain the facts to your superiors and take no further note, and you will be better off.

Sleeping during work hours may be misconduct. Refer to service rules/standing orders.
If video shows clearly that employee is sleeping at workplace and IT is not doctored then where is defamation.
You may rather explain the matter to seniors and fetch their support and help and avoid such instances in future.
