Bank issued the Certificate of sale(Green paper with Rs.20 Non-Judicial stamp affixed) for an auctioned property on 30th May 2013.Can I print the same contents on Stamp paper dated 6 June 2013 and proceed with registration???????

No! You can not.Ask the Bank to execute sale deed as required or tell facts in detail.
Narendiran (Querist) 09 June 2013
We had taken a property on auction conducted under SARFAESI. The bank had issued the sale certificate on the 30th of May 2013. Eventhough the sale certificate is valid and can be directly registered,we like the document to be in the form of a traditional stamp paper. We have purchased the stamp paper with date 6th June 2013 affixed on it.Can we transfer the contents of the Sale certificate issued by the bank on 30th May 2013 in the stamp paper purchased and proceed ahead with registering it?
prabhakar singh (Expert) 09 June 2013
No! You can not do so.

Thanx for the responses..but as we all are aware that a common man is not very happy looking at a green paper when he comes for the purchase of the same property.we have previously registered several documents in the same manner and now its a regular practise which most of the banks approve.

THEN GO WITH WHY TO POSE A QUESTION?????

IF IT GETS REGISTERED IT IS OKAY BUT IT IS CERTAINLY TECHNICALLY WRONG.

What Prabhakar Sing said is right. If a documents is going to register, the entire draft (text) should be print on NJ Stamp

Mr.Narendiran,if you r auction purchaser as per SARFAESI act, there must be no consent of certified debtor,ie borrower of loan.he will creat certainly creat litigation if any procedural part goes wrong.so one should careful of in purchasing SARFASI property.Comman person always in greed of low price goes for such property and because of lack of proper due diligence get stuck ,secondly no bank personals take interests in such litigation once the dues are recovered. After the auction the recovery officer comes to the registrars office the gets the documents register on purchaser name, followed by the physical possession of the property as the procedure laid down inSARASI.

I have got many registered sale-deeds in the similar matters. There is no legal hurdle in getting the registered sale-deed of the property purchased in public auction conducted by bankers even after issuance of sale-certificates.
