(Querist) 03 November 2016 This query is : Resolved
Cheque has been bounced due to insufficient balance which is mentioned in sale deed, but we made payment through RTGS and we have got the bounced cheque with me . I want to know is there's any problem for us or we want to make rectification deed.

When the parties to sale deed agree to modify
the terms of original sale deed, it is necessary to reduce such modifications into writing properly and pay the requisite stamp duty.

It is always advisable to execute the rectification / correction deed. The registration cost for the same is nominal.

it is better to execute a rectification deed. normally this rectification does not require stamp but it is vary from state to state.
Rajendra K Goyal (Expert) 03 November 2016
If stamp on rectification deed in more, you can get the Bank statement of your account, seller account, get a confirmation from seller that they have received full and final amount and amount of bounced cheque due to technical reasons has also been received through RTGS.
