In India what is the procedure to change surname of a child who's mother got divorce and marries again.
1. I just want know that is that possible to change the surname of that child so that he or she can use the surname of step father?
2. is that possible without the consent of their biological father.
If yes pls tell the procedure.

1. For the change of name you are to decide what name do you wish to adopt, prepare an affidavit, get it published in 2 local newspapers and gazzatte notification.
2. Yes, it is possible with the consent of adoptive parents/guardian.
3. For further proceeding seek the services of a local lawyer to proceed in a professional manner.
4. For any such other academic quries consult your tutor.

A parent cannot change the surname of the child without the permission of other parent.

There is law laying down the norms of naming. It is a custom varying from community to community and place to place. However, once a name is reflected in the public records or has become a matter of common knowledge, change in name needs to be effected giving public notice. In case of a minor, the change should be carried out by the minor's guardian.

By adopting the child the surname gets changed to that of adoptive father. But adoption requires the consent of the natural guardian of the minor child, who will be the biological father. Hence I agree with the views expressed by the experts that consent of the biolo9gical father is necessary. After obtaining the consent u have to legally adopt the child.

For changing the surname the consent in writing by the biological father of he child is mandatory. By the way you have started your query like this "In India what is the procedure to change surname of a child ......." What do you mean by saying "In India", which country you belong to?, if you are an Indian, why don't you ask a question starting what is the rule being followed in our country? Are you not feeling proud to say our country?

I agree with the views of expert Mr.M.V.Gupta. Adoption is required and for adoption consent of the biological father is required.
