Marriage between son and daughter of two sister's in valid or not.

(Querist) 10 August 2014 This query is : Resolved
Sir,
This is to inform you that my daughter aged 28 years is missing from home and son aged 30 years of my brother -in-law is also missing from 2nd August 2014.These both are the daughter and son of two sisters.
My brother in law has registered a F.I.R. for missing of his son but I have not registered F.I.R. for missing of my daughter because of badnami/honour as well as I was out of station.
Should I also file a F.I.R. for missing my daughter because 8 days have been waist-ed in searching.
I do not want that my daughter marry with his half blood relation boy, whether as per Hindu law marriage between Son and daughter of two sisters is void ? and what is punishment for these two ?
Sudhir Kumar, Advocate (Expert) 10 August 2014
Unless you belong to south India, the marriage of such Hindus is not legal and void.

In such case if none of them is making complaint then nothing can be done.

In this case if girl wants only then rape charge can be put on the boy for having obtained sex by making a woman wrongly convinced to be legally wedded wife.

Missing diary has no relevance in this case.
Only thing is the marriage is void but no criminal offence is committed.

marriage is void . file missing complaint of your daughter .
Kumar Doab (Expert) 10 August 2014
File missing complaint.

If they wish to listen to elders then they may come out of such incestuous relation or all elders may come to terms with situation.

That is usually what happens!

Later society and relations also accept them back.

Be wise and avoid noise.

Sit with elders of the family and find out the most amicable solution of the situation.

As per custom such marriages are done among Hindus in South India.
Anirudh (Expert) 10 August 2014
I am sorry, there is no custom in South India for marrying between the son/daughter of two sisters. The approved custom is for marriage of son/daughter of brother/sister.
Kumar Doab (Expert) 10 August 2014
The first reply in this thread confirmed such marriages are legal and NOT void if the Bride and Groom as per relation explained in the query belong to Southern India.

The last reply in the thread By Mr. Anirudh affirms that there is no such custom................thus the marriage may be illegal and void.

We will certainly gain from this thread.

Valuable advice of learned experts/members is sought.

File missing FIR.

Marriage if done would be void.

And for sure your's is not a case from south,
we should ascertain from your name alone.

The relationship of brother and sister descending from two sisters falls under the degree of prohibited relationship under sec. 3(g)(iv) of the HMA.

About missing complaint, don't keep silent in view of one missing complaint by your brother-in-law, as that is for his own son, not for both. Must file missing complaint of your daughter, as the police may likely to try linking your involvement in the absence of missing complaint by you. In that case your badnami will be much more than that on lodging a complaint to affect your honour adversely up to any extent.

Such marriage is void, agree with the expert.
Dr J C Vashista (Expert) 13 August 2014
I fully agree with the experts especially Dhingra ji, the marriage is prohibited and void under the provisions of HMA.
T. Kalaiselvan, Advocate (Expert) 13 August 2014
Let the marriage be void and invalid as per law, but where is the confirmation about the marriage ? It is just a presumption as of now. Hence, a man missing complaint is the first step to be taken now, let the complaint go one round, if the missing people surface and narrate what happened between them, the next step can be discussed after that.

Such marriage is void, agree with the expert.
