Is registeration of will mandatory?

Dear respected experts,

One of my relatives want to give a property through a WILL.
1) Kindly advise me if he WILL has to be registered? or without registeration can I keep the WILL with me?
2) Do I need to prepare the WILL in stamp paper or in bond sheet?
3) What would be the registeration charge if it is to be registered?

Ans. Registration is optional but highly recommended to safeguard your interests.

2) Do I need to prepare the WILL in stamp paper or in bond sheet?

Ans. A will on a plain A4 size paper is sufficient there is no requirement of stamp paper.

3) What would be the registeration charge if it is to be registered?

Ans, Generally it costs about Rs 250 in A.P, charges for registration may vary from state to state.

Dear Querist
the registration of Will is not mandatory, it's only optional, no stamp paper is required, but for future safeguard, you can registered the Will.

Though not necessary, it is recommended to register a WILL, as if challenged, it favors to prove WILL.
No need for Stamp Paper, and Registration cost differ, say abt 1k ;

It is advisable to register the Will as unregistered will creates lots of confusions and problems.

1. No. Registration of will is not mandatory.

2. No stamp duty is required for will. It can be executed even on a plain paper.

3. The charges of registration will is nominal. (Below Rs.1,000/-)

So the conspectus of opinion is that ' A will Deed/bequest is NOT a Compulsorily registrable documents".Even if an inscription by a sane or a person of sound mind,written in his diary & signed by two adult persons,is as VALID as a registered deed of Will.....No Stamp papers/stamp duty or registration is compulsory.
As a SAFEGUARD or as a measure of caution one may get such a deed registered.

Registration of Will is not mandatory. Though if Will is registered, than at the time of dispute, the due execution of Will will be presumed and not required to be proved. Will could be written on plane paper. Only thing is necessary that it should be attested by two witnesses necessarily. The registration charges are nominal and differs from State to State.

agree with common views of all ld. experts. I would also add on above reply that if agriculture land situated at Uttar Pradesh, then Registration of will is compulsory.
