Information through rti

(Querist) 11 February 2012 This query is : Resolved
Sir,
Through RTI i wanted to know why my pending legal matter before a particular hon'ble high court bench after series of regular proceedings had been sent to the chief justice for the nomination of another bench?
non of us had requested for the transfer of the case.
through reply of joint registrar the same has been returned unreplied and returning my postal order uncashed. stating interpretation of law, opine, comment, advise or issue direction to any authority on legal matter, therefore application for the information is rejected.
Pl suggest me what is the further action which i can take and where to apply so that i can get the desired information which is very vital for my case.
the above action need urgent attention and action. my application was dated 08.12.11 and the rejection application is dated 09.01.12.

Hmmm,

Maybe the judge has rescued himself from the case.

But as it is actually a matter pretaining to the opinion of the concerned Judge, the RTI is rightly rejected.

Instead of going for the RTI, you could have written a complaint to the chief justice,
Advocate. Arunagiri (Expert) 12 February 2012
If your RTI application was rejected, you can go for RTI 1st Appeal. If the RTI 1st appeal is also rejected, go to State information Commission on 2nd appeal.

Dear Advocate Arunagiri, thanks for your responds. Now, in case the 2nd round of appeal is also rejected does it mean the 3 round of appeal before the National Commission? I am also interested in this matter.
mahendrakumar (Expert) 12 February 2012
there is no 3rd appeal in rti.

if it is a state matter 2nd appeal to SIC and for central govt related matters,2nd appeal to the CIC.

@Mr. N.K. Sunami

There is no national commission under the RTI Act. One can go High court against the order of SIC.
prabhakar singh (Expert) 12 February 2012
Mr.Shah is right in his saying that there is no national commission under the RTI Act.One can go to High court by writ against the dismissal of appeal by SIC.

Advocate. Arunagiri (Expert) 12 February 2012
If the SIC had dismissed the case, you can go for WRIT in the high court, add SIC as a party in the WRIT.

There is no vital issue involved in the present matter. The judge trying the case cannot be enforced to tel the reasons denying the case to be heard by him.
