Need help to do FIR against Family Members

Querist : Anonymous (Querist) 07 June 2010 This query is : Resolved
Hi,

I am 26 years old and self employed. I am runningmy own business past 5 years and I am able to meet my needs with the earnings and self dependent.

Being a girl my parents forced me to a marriage ceremony inspite of my oppose and to get rid of the marriage i moved out of the house well in advance before the scheduled marriage date.

When I moved out of my parents house, my parents emotionally blacked me and called me back at home and With strong oppose my family cancelled the marriage.

Later immedaitely they stopped me from going out of the house, attending phone calls etc and forced me not to continue with my business any more. I am under lots of pressure from my family and have become mentally sick. From past more than 2 months I am sitting at home under family pressure.

I want to move out of my house and my decision is firm and want to stay in working womens hostel and start my business activities at the earliest.

I need your expert advice what do i do so that my family do not make a police complain against me and force me to come back home and i can settle my life the way i want.

Please advice

Sheetal

Dear Anonymous,

There are two limbs of your query. One is legal and the other relating to the need for counselling.

I would like to take up the later one first. You are the best judge of your destiny as you have not stated the reason of (probable monetary greed as you have stated that you are/capable of earning). Or the social stigma that despite being 26 years of marriagiable age you have not married. More so whether you have tried to reason it out with your parents as such.

Secondly being a adult legally you do have a right to lead your life as you wish for this reason you can move ahead with your life whatever way you wish and in case your family is making misuse of local police you have a remedy of approaching the High Court in the Writ Jurisdiction and definately can get directions against police for not harassing.

Best Regards

In fact there is not much to add more than what Daksh suggests.

Being of a marriageable age,the concerns of your parents should not be easily overlooked.
to break these ties are very easy. If possible try to reason with your parents(since they had cancelled the earlier marriage proposal).
