I am one of the tenant for 32 years In a commercial property ,with lease agreement period till 2013 June.i have paid rent up to date.My landlord had some property tax dispute with the corporation and had some Tax due which my land didn’t pay. So I had to pay the huge amount property Tax dues after receiving TENANT NOTICE (OCCUPIER NOTICE) from corporation .
Now my landlord has sold the property to someone else,with out giving me the Tax amount which I have paid to the corporation.
Now do new landlord have rights to vacate me even tough I have the lease agreement period till 2013 , Do I legally have rights to clam the Tax amount from the new landlord which I had paid.

The new landlord can not evict you before the expiry of the lease. However since you know that a new person has become a landlord by way of purchase you can give him a letter of attornment stating your readiness to apy him the rent. As the property has already changed hands it will be difficult for you to claim the excess corporation tax though you can adjust the said amount from the amount of rent in the successive months.

You have to write a letter to the new landlord about the fact that you learnt that he has purchased the property and became the owner. In the letter you may also mention about the corporation tax paid by you and request for payment. You conclude stating that you have entered into the lease agreement with the erstwhile owner and the lease agreement expires in 2013.

Send the letter by registered post acknowledgement due and await his response.

is your new landlord collecting rent from you?

if not try to send him rent and ask for rental receipts.

Tax paid by the occupier - tenant could be advance rent and so-claimed against future rent payable !
Let the fact be known to the current owner who may now be entitled to receive rent till your contracted term of tenancy with the landlord in whose shoes the current owner would be deemed to have stepped in !

The present owner could not forcefully evict the tenant.When you get the notice give reply mentioning all this.You are bound only to the early owner.Give a notice to the early owner to deduct the monthly rent payment to compensate the amount paid as tax.
