498a IPC

My wife lives 40 k.m away from me in her brother's residence under different police station.We are not in talking terms.
1) can she file 498a from there?
2) if i file divorce can she then file 498a.
3) if i have proof that she lives seperately can police arrest me after she files 498a.

As a head of the family find out cause of the dissonance and call her back .Dragging the matter before court or Police station will spoil the relationship and precious time .If there is any unavoidable matter try for mutual divorce petition.
