Publication of General Notices in Dailies

Sirs
Number of Public notices are being published in the News Papers thereby inviting claims and objections prior to completion of land registrations sale with supporting documents for consideration by stipulating time limit.
Kindly indicate such publications are mandatory prior to finalisation registration process, its merits and demerits and in case objections are received is it necessary to furnish to the Sub Registrars concerned. Is such publication of notices in news dailies are also necessary in case of Gift Settlement Deed registration and if so to kindly indicate relevant act/clauses/rules

It is not legally mandatory but definitely it is for safe side to get publish such public notice so that future complications may be settled at this earliest stage. There is no guarantee that no dispute shall arise after such publication but its possibilities remain lesser.

Such publications are discretionary and nature of the property.If objections are there,it is necessary to take steps to overcome the same.In the case of Gift and settlement deed also it is not necessary .

Thank you very much for prompt response A few years back the Sub Registrar concerned had furnished an Encumbrance Certificate duly confirming to the effect that no sale transaction(s) took place on the landed properties of my late father In subsequent response to RTI request he has now informed that it has been registered in favour of Husband and Wife without indicating the Link Document (late father expired in Jan 1987) and transactions took place in 2001 and 2002 wITHOUT the signture of my late father (though the landed properties is still in his name even as on date) Can any Land Sale Deed/Gift settlement deeds be registered by any sub Registrar without refering to the LINK DOCUMENT is not necessary to verify earlier records/encumbrance certificates issued by the SRO office If verification is necessary to be done by the Sub Registrar to indicate under relevant Act/Rules/Clauses the SRO has to verify Are such types of FALLACIOUS types of documents are registerable under relevant Act/Rule

The SRO no need to go deep into genuineness of the document.The purchaser only needs to varify about it. If you have any claim over the property you can approach civil Court.If there is any fraud or forgery of document you can also file criminal case.
