will

(Querist) 23 March 2010 This query is : Resolved
can a wife make a will after her husband death if the property is still on the husband name and is the will made valid
Parveen Kr. Aggarwal (Expert) 23 March 2010
If the wife is the sole surviving heir of her husband, she can execute a will even with regard to the properties which have not been mutated in her name after the death of her husband and such will is perfectly legal and valid.
Parthasarathi Loganathan (Expert) 23 March 2010
I concur with Parveen and wish to supplement that apart from his wife there are no claimants to the property as per legal heirship and the property is not charged to any liability
