(Querist) 25 April 2023 This query is : Resolved
My father bought land on my MOM name. At that time MOM signature is not required only seller signature is required and my father took/purchased land in 1968. My father took Patta on my MOM name long back. Patta was on my MOM name till end of 2022. We had paid revenue department tax till 2022, Now in 2023, patta is showing another person name. ON verifying EC it was found someone put my MOM sign and registered in 1971.

I heard based on new law in the TN, we can file this in IG of REgistration. Anyone know, how to file the case with REgistration department.

Any advocate who does things on property in Chennai?
T. Kalaiselvan, Advocate (Expert) 25 April 2023
There are many advocates of this forum who hail from Chennai and practice property laws. You can find one from the list of lawyers of this forum and proceed.
If there was an encumbrance entry in the year 1971, how did it escape your knowledge for all these 5 decades or more?
Are you in possession and enjoyment of the property or not?
Is it a vacant site and remains so till this date?
If it is a vacant site then there may not be a necessity to pay land tax, hence it appears that you are not giving proper details while posting this query seeking an opinion or suggestion to overcome the problem.

If you have the land document registered in the year 1968 in your mom's name, patta is in the name of your mom till the year 2022, then the land purchased in the year 1971 should have been in the name of that buyer in the year 1971/72. So your query requires some clarity. Anyhow as the patta is changed to another person, not your mother, you can submit an application to the District Collector by registered post.
kavksatyanarayana (Expert) 25 April 2023
Sorry, you can submit an application to the District Collector by RP enclosing a copy of your mother's land document regarding the changing of the patta.
KANNAN (Querist) 25 April 2023
Yes it is vacant land and we paid land tax to VAo. When my dad got patta. He did not see this entry. Way back in 1994. Not sure how land grabbers did this job. We came to know only this month. Not sure when they added in registry

so consult District Collector.

Sudhir Kumar, Advocate (Expert) 27 April 2023
You can do settlement only if you so desire.

else you can contest.
KANNAN (Querist) 27 April 2023
Sir, they don't check EC for settlement?

KANNAN (Querist) 27 April 2023
Since there is litigation. Means forged entry id there in EC. Can we do settlement feed?
