Family members right in family pension

Respected Sir/ Madam
My Father Nominated My mother as nominee for Family pension of state govt pension.Now he was died,then remaining family members are also have right on the family pension amount or only belongs to my mother which was credited by state govt.

Your mother ( deceased employee's wife ) is entitled to get family pension and after death of deceased wife or in case of her remarriage his son and daughter who are dependant on deceased employee are entitled to get family pension.

The wife of the deceased pensioner will get the family pension whether she is nominated or not. The children or dependent either a male or female who crossed the age of 25 years or earning member cannot get the pension of the deceased pensioner except widowed daughter/divorced daughter (by court order) dependent sister, the dependent mother will get pension after the wife of deceased pensioner.

Family pension is different subject to nomination for gratuity or benefits permissible to legal representative(s) of deceased employee.

Yes, the query is misconceived. There is no question of any nomination as to entitlement for family pension. Wife of the deceased employee is entitled for family pension in terms of the service law, as applicable.
