What is the Act under which A Father can claim Custody of Children's aged 8 and 6 on permanently without mothers interference, What are the Factors which are due preference or deciding Factors in the Court?

Hindu Minority & Guardianship Act,

Sole consideration is the welfare of the child. Welfare is a combination of various factors. Each and every party to petition put forth evidence in its support stating necessary for the welfare of such child. Court has to weigh the evidence before pronouncing its judgment and decision accordingly is given.

Father being the natural guardian he has got priority to take or keep custody of minors and if the child is capable of giving preference, will be given priority and no doubt the welfare of minor is paramount consideration the court would take into consideration.
