Respected Sudhir Kumar sir,
I have an unsolicited credit card of ABN Amro bank 10 yrs back.used and paid.
The bank closed 10 yrs back.
Now I got a phone call from someone that another bank who has taken over from ABN-AMRO is filing a case under section 420 of IPC.
what I should do now sir?

1. Outstanding Dues of ANY Credit Card does not constitute a Criminal offence under any section and would be classified as a Civil Dispute, to be recovered within Three years. In your case the matter is time barred.

2. You can file a Police FIR, requesting investigation and charge-sheet, for offences like intimidation, fraud, breach of trust etc.... against the person, supported with all relevant supporting Documents & Witnesses.

3. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. T

How does the agents of bank call for credit card dues, which is stated to have been closed 10 years back, unbelievable statement.

The call not from ABN-AMRO bank ( who issued the unsolicited credit card) but from
other bank who has taken over ABN-AMRO bank.Sir, I am an Ex-service man and senior citizen why should I lie to the respected Lawyers? Thank you sir.

in case you admit liability to pay at this stage then the bank has a breathing time of three years to sue you.
