Can anyone suggest me what legal action one can take against someone who sends hoax emails. For example, emails where the sender requests that a particular email to be forwarded to atleast 5 people or 7 people. Will this amount to email spamming. Can it be treated as cyber crime?Please advise me.

No. Such emails are just directory and not mandatory and thus no offense is made out.

Spamming can not be equated with the offences as covered in the provisions of IT Act though you can report such abuses to your Internet Service Provider.

Particular type of e-mail mentioned by you does not attract the penal provisions of Information Technology Act and hence not a cyber crime.

its not covered in IT Act. I do agree with experts.

The alleged Act is not covered under the Information Technology Act. However, if through such email any computer contaminant or computer virus is fed into your system or thousands of such emails are send resulting into email bombing which disrupts your email, than it is a case of cyber contravention or even cyber offence if done with dishonest and fraudelent intention to cause you loss.
