Case of Road accident

My cousin was died in a road accident five year ago , we have filled a case against the car driver . I want to know how long the case will take and what will be the aftereffects if the driver is declared guilty.

Which case has been filed by you, i.e. motor accident claim or FIR ?
You want to know the punishment to driver of offending vehicle when s/he is found "guilty" by court? S/he (driver) will be punished as per law.
You have stated to have been proceeding the case for the last 5 years, it would be better to consult your lawyer.
