Miselling of property

Hi team
In the month of April we booked a under construction flat with lodha palava in dombivali. We have paid them almost 3 lacs for the same however we have not yet done the Stamp duty and registration
While selling the flat we were not taken to the exact location of the flat. We discovered it later that it is at taloja
Also the flat sold to us was different than what was assigned to us and this we realised later when we got our lodha login credentials and the site details were updated there.when we asked them to correct it on their site they refused saying it's not possible however we will get what is verbal told to us.
We approached lodha for cancellation but they are willing to pay only 50% of the amount back
Please guide us what we need to do to get our money back.

First submit written application to Builder to get proper details of flat as well as condition of re-payment (as per your query it is 50% only) which they agreed verbally. Base on acknowledgement, You can file case in District Consumer Forum - If they do not act in due course of time. Written acknowledgement and payment receipt of 3 lacs are important, as it seems you have not signed any agreement specifying the property details. No Advocate is required to file case on Consumer Forum.

You are not supposed to receive only 50%. You may get issue a legal notice and approach Consumer Forum.
