Termination of leave & license agreement

Querist : Anonymous (Querist) 01 July 2018 This query is : Resolved
We are running our business since the last 10 years from a premises which we have taken on a leave & license agreement. The initial agreement had a lockin period of three years. the agreement was recently renewed in 2017 and is registered and valid till 2021, however it does not have any lockin period. The termination clause states that " any party can terminate at three months notice". The land lord wants to terminate the agreement because he is getting a higher rent. We have invested a lot of capital in renovation, licenses, Since its a marriage hall, we have taken bookings for 18 months from now also. What is the legal way out.

The terms & conditions of the registered leave & license agreement have to be scrupulously observed. You have only alternative to arrive at a compromise with the Licensor.

At the time of extension (renewed) of the period, how you did agree and sign the Agreement when you invested a huge amount. As advised by Mr.Mehta ji, solve in an amicable way.

Terms and conditions shall prevail, if the landlord do not want to continue tenancy.
