STAMP for Partition Deed

Dear Sir,

Would the non judicial stamp is requisite for designing a partition deed or the plain paper is sufficient for writing a partition Deed ? If Yes then What is Min value and Max value of Stamp used in Partition Deed ?

A 'Partition Deed' is to be executed only on Non-judicial Stamp Paper and the same cannot be executed on a plain paper. Not only the partition deed requires to be executed on stamp paper but also is compulsorily registrable in terms of section 17(1)(b) of the Registration Act, 1908. Regarding the denomination and value of the stamp paper required for execution of a partition deed, it varies from State to State as different states in India have substituted their own schedules in place of Schedule I appended to the Indian Stamp Act, 1899.

In Karnataka it is Rs. 1000/- per partition. Check the same in your state. Otherwise, the opinion of Mr. Parveen is correct.

plain paper is sufficient to write the partition deed. If you want to register it you will have to pay the stamp duty.
In Karnatkaka mimimum stamp duty for the regn., of partition deed.
