Where to register will

(Querist) 27 December 2017 This query is : Resolved 
respected all seniors, i am confused with one quary i.e one person wants to register his WILL. (there is no doubt that, registration of WILL is optional), still one person wants to register his will. he resides in dombivali. but due to some difficulties he does not want to register his will in Dombivali Sub-registrar. he want to register his will in THANE. dombivali and thane both places comes in thane district only. but still he wants to register WILL at thane. so my question is whether a person can register his will anywhere (in any sub-registration office) where his resident is situate. OR he will compulsory register his will in dombivali area.

A testator can execute and register the Will at any place. The will does not require registration but the last will executed by the testator will come into operation.

Will can be registered at the district where the testator resides. Sub-registrar office shall check his proof of residence and ID.

The will needs to be registered before the Sub-Registrar or the Registrar of the district court under whose jurisdiction a major part of the property lies.In all normal or ordinary cases, the registration process has to be in the offices of the Registrar or the Sub-Registrar. But, in special cases, Section 31 of the Registration Act provides an exception.The section states that the “officer may on special cause being shown attend at the residence” for the registration process of the will.The cause may be ill health, impending the death and other such situations.
