(Querist) 19 September 2016 This query is : Resolved
If I rent my house to a tenant for residential use does this act come under Commercial use of property? I stay in Maharashtra.
Raj Kumar Makkad (Expert) 19 September 2016
Yes. This is purely commercial use.
Raj Kumar Makkad (Expert) 19 September 2016
It shall be income from house property though its use is for the residential purpose or for the purpose you rent it out.
Guest (Expert) 19 September 2016
Rent act is applicable to residential and commercial properties both

Hemant Agarwal (Expert) 19 September 2016
1. "IF" a "residential property (flat)" is given on "Leave & License .OR. Rent .OR. random Paying Guest" for specifically "residential stay", THEN the same CANNOT be classified as "commercial use of property", under the MRTP Act and BMC Act and "commercial property tax" is not applicable and neither "commercial electricity LT2 charges" is applicable.

Keep Smiling .... Hemant Agarwal
