Child custody

My 498a is running in merta rajasthan.i am from surat having a 12 years of male child who is in custody of mother right now.he resides 8 years with me in surat,his mom got custody with the help of surat police and she took him with her to rajasthan during his running school.can i put child custody case in surat? Is this possible that atleast i want visitation rights of my child.

You have a legal right for the visitation but the petition is required to be filed at the place wherein your child is residing at present means at Merta.

My merta lawyer told me to put petition first at surat that the ex has to be moved from rajasthan to surat at the same time he told me if there will be any problem we will transfer the case from surat to merta.is this possible

Petition for custody of child can only be entertained and decided by the court whose jurisdiction child is residing.
