Gwop along with divorce petition

I filed divorce last year and declining to show my 8 year old child to me. A friend of mine (also a lawyer) said that clearly specifies that children under 8 year old must remain with mother and hence, my GWOP won't even even be accepted), since it is against the law.

Would you experts advise? Please share your thoughts and suggestions.

There should be some exceptional grounds for the father to file GWOP to get custody children of tender age from the mother. The posting does not suggest any such grounds.

Generally the custody of child is given to mother, however, you can try by filing.

Father is the natural guardian, apply for permanent custody with interim relief of visitation, you can get it.

Don't depend on opinions because they are not facts. Go to court and try. Courts are dynamic and give relief based on the facts and circumstances of that particular case. You have a good case. Both reliefs are different. Please try.

Thank you all. My concern is that if I apply for child custody, mother will go very defensive and stress out the child a lot. She has already been poisoning my child against me (together with my mother in law). But looks like I don't have a choice.
