Leave & license agreement

Dear Sir,

I am posting this query on behalf of my husband. My husband has vacated a rented accommodation in saki naka on 28the feb due to our wedding in march. However the owner failed to return him the deposit of Rs 1 lac until middle of april. we have been consistently pursuing him to pay our deposit of Rs. 1 lac, however after a lot of pursuasion, he has returned us only 75 k and that too in middle of april. Moreover when we asked his wife to give us a valid justification of deducting 25 k from our deposit,his wife said he will ask his husband to call back and explain. The owner has not returned calls till now and does not pick up our calls as well. Request you to please guide us in this case as we are unable to get back our hard earned money back from the owner.Thank you so much.

do u have copy of the rent agreement?
how did he pay you the amount(75K) by way of cheque or cash?
if you have the copy of the rent agreement file a recovery suit. seek your lawyers guidance in that regard.
also file an FIR for breach of trust and criminal misappropriation of property.

Yes we do have a copy of the rent agreement. He paid 75k by way of cheque. What is the cost involved in filing a recovery suit and where should it be filed. Thank you so much for your valuable guidance

Value of time and cost of filing recovery suit may not be a beneficial exercise. The suit may take 5 or more years.
