Gratuity

Hi Experts,

I am working in a MNC from 22 june 2011. Now i am planning to quit the job. I read like to get gratuity i need 4 yrs 240 days continuous service. But in between i took LOA for 3 months , specifically from dec 15 to march 16. Does this LOA will affect the eligibility for gratuity?

What is LOA?

If it is approved leave then it should be counted in service period.Download the copy of this LOA and approval/sanction.

If establishment works for 6/less than 6 days/week then employee should have worked 240/190 days per year and in 5th year.

I have one more query,

Is it mandatory that the 240 days should be continuous ?

Mine was Loss of Pay due to illness

If they count the days before and after LOP then only I have 240 days . Is it possible to deny gratuity because of this ? I have 240 service days for all the previous years

As already posted, if the leave was approved and did not cause any discontinuation then it may be counted, and you may download the rules, approval, etc and show these to an able counsel, and proceed further under expert guidance of your able counsel.
