Regarding deed to divide the property

(Querist) 15 February 2016 This query is : Resolved
Hello all,

My grandfather bought a property, and after his demise the property came to my grandmother. Now, she is the owner of the property and she wants to divide the property equally between her two sons. My question here is, what is the right way of dividing the mother's property between her two sons?. Also, my grandmother has two daughters, do they have right on that property and if so, what should they do to release their rights and allowing the two brothers the whole right. Please help me in this issue. Thanks a lot.

Grandmother can not be absolute owner of the self acquired property of her husband, expired intestate. She has share in it with all sons and daughters.

She can give her share as she wish.

In the present situation a registered family settlement would be better, Or daughters may execute registered relinquishment deed and mother may bequeath a will for her share.

In your case the property has five shares.. mother, two sons and two daughters.
The daughters certainly has the right to get their share unless they release their right on paper with registered document executed.
