Illegal encroachment on open space of society's road

Sir, myself Govind A Patel and my Brother Harshad A Patel, residing at 3/A, Amarganga Society, Opp H P Petrol Pump, Jivrajpark, Vejalpur road, Ahmedabad would like to present the following complaint/representation on the above subject matter.

The 6.2 mtrs wide Internal Road of the our Society passing through Tenament No. 1-A, 2-A, 1-B, 2-B, 3-A, 4-A, but the Owner of Tenament No. 1-B Veljibhai V Patel and 2-B Tilakraj Deshraj Gandhi had erected a illegal Wall closing the 6.2 Mtrs. Wide Road along with the boundary line of Tenament No. 1/B & 2/B, thereby causing rain water blockage and hindrance to traffic flow from in and out of the Society & causing a lot of problem to me and other residence.

The illegal construction constructed by owner of Tenament No. 1-B, Shri Veljibhai V Patel & owner of Tenament No. 2-B, Shri Tilakraj Deshraj Gandhi has blocked/reached up my entrance gate which is in my view completely illegal, which causing lot of problem to me in daily routine of life. The visitors visiting the houses of above persons are parking their vehicles in front of the entrance of my house. Some times, I am not able to enter in my house too, because of the said nuisance of parking their vehicles at my Gate. Frequent, requests have been made to the above persons for removing/infringed the said illegal construction, but, despite of the fact, the wall has not been removed.

In view of the above, the constructions of wall as discussed hereinabove is illegal, as per the approved Layout Plan No. DRM/UAD/4174/2478 dated 02/04/1978, Survey No 552/2, Final Plot No._49_, T.P. No._2_, of the Society. It is therefore requested to remove the illegal construction and open the road for benefit of the entire Society members.

In this connection, it is to bring to kind notice that I alongwith my wife, my son, my daughter and my old mother leaves alone. Recently, I had undergone Bypass Surgery. Further, my wife is also suffering from hypertension. Due to our old age our health does not remains in good condition. Further, due to illegal Construction made my neighbourhood creates unnecessary tension to both of us and caused hardship, physically and mentally harassment.

The Owner of the Tenament No 2/B Mr Tilakraj D Gandhi��s son Nitin T Gandhi is a lawyer. Therefore, he had done several civil and criminal cases on us and other society members and the respected Chairman and Secretary too. By doing this, he is harassing all the members of the society and that way, he is being obstacle in the works of development of the society.

Kindly suggest us that where we have to approach for above mentioned problem in legal way to solve our problem.
