Mrself Reena and have one query. Plz suggest me what to do. My father saw ad in newspaper and saw one site which was about to start it's construction for apartments, but somehow they did not get approval from 1yrs and my dad has paid 3 lakh advance. Which they are not refunding now and saying some or the reason, after many approaches they have given one cheque sum of 3 lakh, we tried to cash them, but the banker said there is no fund in account to cash them.
What should we do now..?

Author, the query implies that without any agreement your father paid the amount. however you file a case in a court of law against builder/vendor in consultation with a well versed lawyer of your area. keep the bounced check given by vendor and show it to the counsel.

Immediately send notice and in due time file case of cheque bounce u/s 138 N I Act.

File complaint under section 138 of Negotiable Instruments Act by consulting a lawyer.

As suggested by experts an action under the provisions of section 138 of NI act can be the next step to be initiated now.
