Last will

Hi, My dad has two sons, me and my brother. He had made a will in 2010 giving all his property to me and my brother 50:50 equally. He has for last 5 years been staying with my brother. I live abroad and help my brother with money. My dad's mental health has deteriorated substantially. How do I check that my brother has not hot my dad to make and register another will leaving everything in my brothers name. How do I confirm which is my dad's last will?

Basing on your curiosity A will could be changed or cancelled during the Life time of the Testator.Better organise to execute the Settlement Deed of 50% each to the sons at Registrar office for which your presence will not be required and You collect the Documents thro your Representative Or Agent who could be Present at the time Of Execution of Settlement Deed and if possible collect the originals also.Consult A Local Good advocate.For Settlement Deed the Registration and Stamp Fee would be Very Less Roughly Less than Rs.50000/- only.

Thanks Sir, but this settlement deed will have to be signed by my dad? he might not be physically or mentally able to do so? or this has to be signed by me and my brother?

There are Facilities Like Registrar would come home for Registration on valid Grounds Like this.Consult and appoint a Local Good advocate to do this.(Please come out with your name)

Settlement Deed could be Revoked/cancelled subject to Various Conditions and most Important is All the Documents including the Settlement Deed Should be with the Executor.Depute a Influential Person at the Registrar Office to Check On that.Normally the Will and its Cancellation will Not reflect in EC.

You are apprehensive.


Come to visit your parent.
Meet an able counsel in person.


Choose from irrevocable gift deed/sale deed, if that suits you.


Probably the value of property is more than the expense involved.

Ask your father to cancel the Will. Then request him to dispose of all his property by gifts to his two sons by way of irrevocable gift deeds.

I think you are too apprehensive about nothing, However if you anticipate anything to go averse against you, better visit India once and clarify and set right everything properly and confirm.
