Cancellation of sale deed

I sold my flat to someone and received payment and executed registered sale deed in his favour. But later on I noticed that one of the cheque of rs. 4 lacs mentioned in the Sale deed had not been received by me. But by mistake i signed in sale deed and it was executed in buyer"s name.
When I talked to the Seller, he said that he will pay this amount in any way but even after sending notice, he has not yet paid the the payment and enjoying the occupancy of that property.
NOW, pl advice that whether i should file the civil suit with pray to cancel the sale deed or recovery suit to get that remaining payment to me.
Do i have to pay any court fee for that .
My O/s payment is rs 4 lacs and total cost was 20 lacs.

@author, you can file a civil suit in the court of law praying to recover the balance amount as the purchaser did not pay the full consideration though mentioned in the sale deed. consult a local lawyer who well versed with the knowledge of this type of cases.

Civil suit for recovery need to be filed, court fee is to be paid on claimed amount.
