Regulation of private tuition/coaching centers in assam.

(Querist) 17 October 2015 This query is : Resolved
Hello Respected Experts,
I am planning to establish a tuition center in my hometown. And I have documented all the details which are necessary to open a tuition center but the problem is that I am new in this field and thus know little about the legal documentation of the institution like- is there any need of registration/permit for the same from govt. body and if so then what is the step by step process for the same. And I think it is necessary to mention that yes as of now it's a small business plan which will comprise me and some of my employees but on the basis of its growth I will expand it.
So if you help me in finding out the solutions of my problems it would be a great pleasure for me. Thanks for your time.

Running a tuition centre or home tutoring service is one of many options when it comes to setting up a business from home. A centre can be small or large, based at home, or in rented space.
Arrange for the excellent and expert teachers as per the requirement of the standard
Decide the location where you want to start
The education board for which you will provide education i.e. GHSEB, MHSEB, CBSE etc.
Make sure that enough no. of students will come to justify the existence of your new venture.
Determine the fees to be charged for each course, standard depending upon the factor which you may know better
Provide discount, follow liberal policy to charge the fees.
Coaching centres today have come out from being a home based coaching practice to a well run industry.
If you’re going to hire other teachers for you coaching centre then this is certainly a vital step to take. Competent staff depending on the need of the students and the subjects you are covering needs to be hired.

if your coaching centre is in small type then ypu need not proceed for any permission.but if you wish to make it large then and turn over a large amount of money then you need to registered as a trade license maybe under shops and establishment act..

Thanks for the reply Mr.Kalaiselvan. It is really helpful but It will become more helful if you elaborate the difference between small type and large type, I mean in terms of money and manpower. Once again thanks for your time.

There are no legal issues involved. The proposed occupation is protected by the Right to Freedom protected under Article 19 of the Constitution.

Thanks for the reply Mr. Venu. As you said no legal issues involved in the occupation, but if we take it as business entity with some employees then is there any need of license from govt. body. Once again thanks for your time.

You may register it in the shops and establishment act.

So it doesnot matter how big or small the institute is? We can register it in the shops and establishment act.
T. Kalaiselvan, Advocate (Expert) 18 October 2015
For small establishment, no need for registration, especially when there are no regular employees employed.

Dont get confused over the legal jargon terms or names. You may take the advise of an expert consultant in the local who will be able to guide you properly on all such further issues.
