Partition suit

(Querist) 16 October 2015 This query is : Resolved 
Sir
I am a respondent in a partition suit which filed by my sisters and brothers
I submitted my statement thru a lawyer in munsiffcourt.actually, I don't have any objections to complaint. Due to my financial status,I cannot proceed future steps.so my lawyer will not appear for me in court.in this circumstances, how will case ends?is there any chances to lose my share in family property?

It appears that, through the Written Statement, you have conceded the plaint. Now after all the parties file their pleadings and trial, if required, the suit may be allowed or dismissed. In the former case, a preliminary decree would be drawn up. Subsequently, any of the parties can move for final decree.

Any how, there is no case of losing your legitimate share in the family property.

If your lawyer does not appear due to your financial conditions, you can appear yourself and proceed.

You may, besides filing your written statement, file a memo stating that you submit to the decree prayed for by the plaintiff and since you are also entitled to a share in the property you would like to make a counter claim by paying appropriate court fee for the purpose. Your memo will be allowed. Your share in the property will be secured.
