If the property is in the name of the children or they have a share in the ancestral property, permission of the Distrct Court is reqd. for selling/encumbering their part of the property.

Where the ownership share or title is with the minor children or any adult who is of not sound mind and dependent, a permission is to be taken from the Civil court Judge by the Guardian of that person before alienating the property on his behalf otherwise the alienation of the property will not have any legal effect and will be void.
