Sale of lands under provisions of bombay tenancy and agricultural lands

Question regarding the sale of a land that comes under Bombay Tenancy and Agricultural Lands

Can Landlord and Tenant sale their BTAL's land jointly to some other pruchaser farmer without taking permission of the concerned authority such as the concerned district collector ?

Is it necessary that either proceedings u/s 15 or 32-G must take place of the said act before sale of the said land ?


If any of of the above 3 procedures have not complied with then joint sale of such land done by landlords and tenants becomes invalid or void u/s 84 read with Section 64 ?

The said land is in Village and about to go in municipality jurisdiction soon as per govt. town planning scheme, but when sale deed was made jointly by landlords and tenants with another purchaser farmer the said land was in village.

The tenant has no concern with the sale transaction except to hand over physical vacant possession of the property whenever the landlord asked him so. The landlord is the title holder of the land who can dispose it of, if desired. It do not attract the provisions of Rent (Tenancy) Act.
However, check it with a local lawyer for proper opinion.

1. BTAL dominated lands are classified as "Specific Purpose Land", by the zonal collector. Hence such Lands are subsequently & consequently Transferred "ONLY & ONLY" with the "PRIOR" written order of the Collector, irrespective of the classification of new buyer.
Anything contrary to the above is null & void and the related land shall be liable for govt. confiscation.
