Innovating new dates during cross examination

Hi Experts,

In my bhabi's fake fir and fake DV affidavit. She has not mentioned any date and time of any alleged cruelty.

Now, during my brother cross examination they are innovating new dates for alleged incidents.

They are asking question to my brothers whether on so and so date u taunt her.

Does he still have to answer in yes or no...?

he has to answer but put up a solid proof against it in your evidence stage

No no no he is not bound to answer, tell him to be very specific in answering, it's there case let them prove ....
But did your brother moved an application to be examined as a defence witness ... ?

It all depends upon the type of question posed by the counsel of your bhabhi/ complainant. Neither question nor its reply can be predicted and spoon-fed at this stage, I am not an astrologer.
Your brother is require to be tutored by his lawyer, consult him/her.

That should be pointed out to presiding judge of the court by objection by your brother or by his lawyer ,if any.

Prabhakar Sir, I have spoken to my lawyer regarding this. She said they can frame dates during cross examination even though dates were not mentioned in FIR and DV affidavit.

Is she correct.......?

This is a matter of circumstantial evidences being played by the opposite party to corroborate, better be vigilant while answering the questions shot at.
