Court appearance for final divorce hearing

(Querist) 03 December 2014 This query is : Resolved
Initial decree was passed for divorce. All 498A quashed in high court. Girl signed initial divorce papers
6 month waiting period. Settlement was received and signed as received by Girl
Final hearing for divorce is fast approaching.
Do I have to be in court in person?? I am abroad and want to avoid travelling to India...visa stamping
and in visa i have to declare spouse legally separated etc and I want to avoid all this.
Can my Father represent me with a power of attorney?
I really want to avoid traveling to India. Please advise.

yes, your father may represent you through power of attorney executed by you in abroad and duly verified by Indian High Commission.

you need not remain personally present . if court has video conferencing facilities you can inform the court that you are agreeable for divorce by mutual consent . you can also give POA to your father

In such hering POA is not sufficient, You have to personally come.

This is the crux of my problem. Girl is getting F1 and desperately waiting to join the Spring semester starting Jan. I believe she is as urgently needing divorce as I am. As she has already received 20 lacs in settlement pending 5 more.
I keep getting these conflicting messages where as there are some cases where court waived the need for personal appearance. I am praying lawyer is able to get through this without my presence. He also says I need to be present but then will give it a try.
Devajyoti Barman (Expert) 06 December 2014
Do not take the rsit. The court is very much unlikely not to pass any order unless you appear.
Appear in this case and end ot for good.
