Discrimination on the basis of marks

(Querist) 28 October 2014 This query is : Resolved
Sir am a student. Me and my friend have been given constantly lesser marks than other students by our teacher. He also encouraged cheating in examinations for other students of our class. We waited for the college authorities to take necessary action against the teacher but no action was taken by the college. We are fearing that our last semester results which is
expected to be out soon might be tarnished and a research paper which is to be submitted by us (holds importance for award of degree) is stuck because of that teacher.Kindly sugesst necessary legal action

Is the college a govt. aided institution?
If yes then you can file writ petition in high court.
For private college you have to write to UGC.

Any legal action would not fetch immediate relief to you. You can meet the teacher and humbly discuss the whole issue. You can take help of some senior or student representative. It would always be better to request in person and individually.

The action of revenge against you people is the result of your activities exposing the teacher's illegal acts. No doubt the culprits are to brought to books, but while on such sensitive stage, you could have maintained a restrain or patience. There is no legal action that you can initiate against the teacher as of now if at all you want to initiate one you have wait for the outcome and see if something has went wrong against you intentionally, before that you do not have a proper cause of action. You may approach the principle/head of the institution expressing your fears anticipating the teachers vengeance as a precautionery measure.

Then bring this discrimination to the notice of the HRD Ministry and the UGC.
Filing civil suit is another option.
