Rectification deed not executing by seller

Hello Sirs,

I bought a Plot in Bangalore Panchayat limits, The Dimensions it was mentioned wrongly that East to West 30 Ft and North to south 50 feet, actually it is in reverse way i.e., East to West 50 Ft and North to South 30 Ft. The seller keep postponing to do the rectification Deed. I saw one of the comment in forum that need to file a Suit. if i file a suit how long it takes. How much it would be legal charges. Could you please help me on this. If possible can i have advocate who can do this services in Bangalore?

It may take a period of about 2 years. Charges/expenses depend upon place to place and person to person. You should personally visit the court compound and should fix the charges.

Expenses depend upon the fees of lawyer and other expenses differ from place to place.

Case generally take 2-5 years.

Thanks a lot for your reply. It takes that much of time even the layout plan and other document proofs shows that the dimensions were wrongly mentioned. Is there any other way to do it sooner.

A rectification deed to be executed by the vendor in favor of the purchaser is the only option or else to approach court of law with a declaratory suit declaring the proper check boundaries of your property based on the documentary proofs in your possession. A suit in the court normally takes a little more than 3 years in due course. Hence the other option is that you may approach the registrar with an affidavit on the basis of previous relevant document showing the correct boundaries, if he is convinced, you may be allowed to rectify the minor error and an effective deed can be executed to this effect.
