Not mentiong suspension preriod as duty

Respected Sirs,
One employee suspended for misbehaviour with other employee .The enquiry completed after that competant authority held up his 5 increments but revoke his suspension but forget to mention in suspenssion revocation order regarding whether suspenssion period treated as a duty period or not.this is order is passed in 2007. After his retirement Employer pass the order regarding treat suspenssion period as punishment then employee raise griviance regarding treat suspenssion period as duty period before councillation
Officer Under IDA 1947.what is the effect of not mentiong about suspenssion period & Mentioning it after retirement of employee ?Thanks in Advance

1. If the suspension order was revoked it implies that the suspension period was not reckoned as off duty. The retired employee's I.D. case will survive.

Every suspension Order should contain an order stating about the treatment of suspension period. If it is absent, the employee can take advantage and fight for treatment as on duty.
